Nito Bikes (“Nito Bikes” and/or “Company”) Products are built of superior materials and in accordance to stringent quality standards. With adequate and proper maintenance, it can provide you with years of reliable use. However, like most products, it is subject to wear and tear.

Manufacturer’s Limited Warranty (USA) 

This is the manufacturer’s limited warranty (“Limited Warranty”) for the Nito Bike N1e (“Product”) for consumers in the United State of America. This warranty is only offered to the original purchaser of the product, and is not transferable to a subsequent purchaser.

This Limited Warranty describes the service available to you in the event your Product requires warranty service, and you may have additional protections under your local laws. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE. 

This sheet and the original purchase receipt for the purchase of your Product are the documents defining the Limited Warranty. Please retain this document and the original purchase receipt to preserve your warranty service.

Please register your Product either electronically via our website or by completing and returning the registration card found in your owner’s manual. 

If, during the limited warranty period, this product appears to contain a defect covered by this limited warranty, email hello@NitoBikes.us, for warranty service instructions. You will be required to have registered your purchase at www. and provide a dated proof-of-purchase receipt with any product returned for warranty repair.

We may, at any time, and at our sole discretion, modify these Terms with or without notice to the User. Any such modification will be effective immediately upon public posting at www.nitobikes/termsofuse. Your continued use of Nito Bikes following any such modification constitutes your acceptance of these modified Terms.

1- WARNINGS AND PROPER USAGE

Product is a battery-powered motorized scooter that is intended to be used solely under certain environmental and operating conditions, as further described here. You agree that you will use Product only in the manner and under the conditions described here, and that you will avoid using it in a manner that is obviously inadvisable, or under hazardous conditions, or under any other conditions for which Nito Bikes has issued warnings. You agree to follow and obey all operating requirements and procedures of Nito Bikes.

A- OPERATION AND SAFETY

Product is designed to work solely with single riders. Product’s maximum carrying capacity is 260 pounds. This weight limit includes the weight of the operator as well as all items and supplies held or worn by the operator.  Should the motor become overloaded, the Product will automatically cut the power. Product’s controls limit it to a top operation speed of 15 mph. Product is designed and intended for persons 16 years and older with a valid driver’s license. Persons under the age of 16 without a valid driver’s license should not ride or operate it. 

Product is intended to be used by a single rider or by a single rider sitting on the seat, or by a single rider standing in an upright position with both hands on the handlebars. Never place anything other than your feet on the floorboard. Never place your hands or feet anywhere in or near the wheels. Do not wear loose fitting clothing, or ankle or shoe jewelry. Always face forward while operating Product. Brake smoothly and allow sufficient braking distance. Use caution when operating near other cyclists or pedestrians. Do not operate Product on highways. Product is not a toy.

Always wear a properly fitting and approved bicycle helmet when operating Product. 

Use caution and reduce speed when using Product in rainy, icy, or snowy conditions, or in other conditions where you could lose traction. Do not use it on grass, sand or gravel. Always ride at a speed that is safe for you and others who are around you.

Do not operate Product while you are under the influence of drugs or alcohol. 

Do not operate Product while talking or texting on a mobile phone or other electronic device.

B- OWNERS MANUAL

The operator of Product must fully read the Owners Manual included with the product PRIOR attempting to operate Product. Please refer to the operator’s manual for battery charging, care and maintenance information.

2- LIMITED WARRANTY PERIOD

This Limited Warranty covers all defects in material and workmanship of the Product arising or occurring as a result of your normal and ordinary use of the Product. In the event a defect covered by this Limited Warranty occurs, Nito Bikes will repair or replace your Product in accordance with the terms of this Limited Warranty. The applicable period for the Limited Warranty begins from thirty (30) days following the original purchase date of the Product from NIto Bikes or an authorized Nito Bikes distributor or dealer and applies to the Product in the following ways:

3- Limited Warranty Service Process

Should you discover what you believe is a defective Product, please contact Nito Bikes at (310) 339-1224 or at hello@nitobikes.us. Nito Bike’s technical support personnel are available to assist you in diagnosing and fixing any problems you may encounter in the use of your Product. In the event we cannot help you fix the problem, you may be entitled to warranty service under this Limited Warranty. In order to submit your Product for warranty service pursuant to this Limited Warranty, you will be asked to provide us with (i) the proof of purchase from Nito Bikes or an authorized retailer; and (ii) the Product’s serial number. Upon verification of your eligibility, you will need to provide your name, email address, mailing address and contact telephone number in order to receive a return materials authorization (“RMA”) number. Nito Bikes must receive your defective Product within thirty (30) days from Nito Bike’s issuance of an RMA to you. Nito Bikes may direct you to a designated third party for warranty repairs. You must include your defective Product within the Nito Bikes-provided or Nito Bikes-approved packaging for shipment to Nito Bikes. You are responsible for any damages caused by your improper packaging or shipment of the Product to Nito Bikes, or risk of loss during transit.

An authorized service provider will conduct an inspection of your Product. If Nito Bikes determines that the problem is not covered under the Limited Warranty, Nito Bikes will notify you and inform you of service or replacement alternatives that are available to you on a fee basis, or Nito Bikes will return your Product to you unrepaired. For eligible warranty claims, Nito Bikes will either repair or replace the product at no charge, using new or refurbished replacement parts are our discretion. Replacements may be different but functionally equivalent models. Parts replaced by Nito Bikes will be retained by, and become the property of Nito Bikes. For eligible warranty claims, Nito Bikes will pay reasonable return shipping charges for the return of the Product to you.

4- LIMITED WARRANTY ELIGIBILITY 

You must meet all the requirements below to be eligible for the Limited Warranty.

1. Your request for service must be received by Nito Bikes within the Limited Warranty Period as described above, and we must receive your Product in accordance with the Limited Warranty Service Process defined above; 
2. Your Product must be purchased from Nito Bikes or an authorized rei of the Product;
3. You must retain the original purchase receipt and your Limited Warranty, and provide this documentation to Nito Bikes to verify your warranty eligibility;
4. Your Product must have the serial number clearly legible and unmodified.
5. Your Product must have its tamper-resistant seals in place and unmodified.

5- LIMITED WARRANTY EXCLUSIONS

This Limited Warranty describes the service available to you in the event your Product requires warranty service, and you may have additional protections under your local laws. 

This Limited Warranty will be void if the product is ever:

1. Used in a manner other than for recreation or transportation
2. Modified in any way
3. Used as a rental or for commercial purposes

This Limited Warranty does not cover and excludes damage to your Product:

1. Caused by misuse or abuse of Product. The Product must be used for its intended purposes for which it was designed.
2. Caused by neglect or poor maintenance. 
3. Caused by rental or other commercial use.
4. Caused by improper charging, storage, or operation, including, without limitation, use contrary to the owner’s manual and other documentation, use other than in accordance with specified weight and age limits, use on stairs, walls and curbs, or any extreme sport or exhibition use.
5. Caused by accident, collision, riding over obstacles, racing, fire, water submersion, high pressure water spray, freezing, earthquake, dropping, severe oxidation, or chemical solvent corrosion.
6. Caused from improper packaging or mishandling during shipment to the warranty-service provider.
7. That is cosmetic, including, scratches, dents and the removal of protective coatings that are designed to diminish over time, unless such damage occurred due to a defect in materials.
8. Caused by the use of the Product with, or any modification to the Product using, any third party product, component or accessory that is not sold by Nito Bikes.
9. That does not arise from Nito Bike’s product-design, technology, manufacturing or quality. 
10. Caused by normal wear and tear due to the normal use of the product.

6- LIABILITY DISCLAIMER AND LIMITATION; CALIFORNIA LAWS

ALL IMPLIED WARRANTIES FOR THE PRODUCT, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN DURATION TO THE ONE-YEAR LIMITED WARRANTY PERIOD SET FORTH ABOVE, AND NO IMPLIED WARRANTIES WILL EXIST OR APPLY AFTER SUCH PERIOD. Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you. THIS LIMITED WARRANTY DOES NOT COVER NON-DEFECT DAMAGE, DAMAGE DUE TO NORMAL WEAR AND TEAR, DAMAGE CAUSED BY IMPROPER OPERATION, MAINTENANCE OR STORAGE OF THE PRODUCT (INCLUDING, BUT NOT LIMITED TO ABUSE, MISUSE, FAILURE TO PROVIDE REASONABLE AND NECESSARY MAINTENANCE, UNAUTHORIZED REPAIRS OR ANY ALTERATIONS TO THIS PRODUCT).

IN NO EVENT SHALL NITO BIKES BE LIABLE FOR ANY INCIDENTAL, INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES OR LIABILITIES (INCLUDING BUT NOT LIMITED TO INCIDENTAL OR CONSEQUENTIAL DAMAGES FOR LOSS OF TIME, INCONVENIENCE, LOSS OF USE OF PRODUCT, OR ANY OTHER CONSEQUENTIAL OR INCIDENTAL LOSS) IN CONNECTION WITH THE PURCHASE, USE OR OPERATION OF THE PRODUCT. NITO BIKES IS NOT LIABLE FOR THE PROPERTY DAMAGE, PERSONAL INJURY, OR DEATH.

You agree to comply with applicable laws. Some states do not allow the exclusion or limitation of consequential, incidental or special damages, so the above limitation or exclusion may not apply to you. This limited warranty gives you specific legal rights, and you may also have other rights, which vary from state to state.

The use of Product on public roads and sidewalks may be regulated or prohibited by local or state regulations. Company does not warrant or guarantee that it may be legally operated on any roadway, sidewalk, path or related area, nor does Company warrant or guarantee that it may be legally operated in your jurisdiction. Certain jurisdictions may set minimum age limits or license requirements for the use of Product, and/or require protective gear to be worn. You agree to review all local rules, laws and regulations that are applicable to your use of Product, and to comply with them.

You agree to defend, indemnify, and hold harmless Company and its agents, servants, employees, officers, directors, trustees and all other persons or entities acting on its behalf, from any and all claims, actions, damages, liability, costs or expenses and attorney fees that arise out of the death or injury to person or damage to property resulting from the use, operation or ownership of Product by you, whether or not such claims, actions, damages, liability, costs or expenses are caused by the negligence of Company.

CALIFORNIA VEHICLE CODE § 407.5(c)(1) DISCLAIMER

YOUR INSURANCE POLICIES MAY NOT PROVIDE COVERAGE FOR ACCIDENTS INVOLVING THE USE OF THIS PRODUCT. TO DETERMINE IF COVERAGE IS PROVIDED, YOU SHOULD CONTACT YOUR INSURANCE COMPANY OR AGENT.

CALIFORNIA VEHICLE CODE § 407.5(d)(1) DISCLAIMER

YOU MAY NOT MODIFY OR ALTER THE EXHAUST SYSTEM OF THIS PRODUCT TO CAUSE IT TO AMPLIFY OR CREATE EXCESSIVE NOISE PER VEHICLE CODE SECTION 21226, OR TO FAIL TO MEET APPLICABLE EMISSION REQUIREMENTS PER VEHICLE CODE 27156.

International Disclaimer (for products purchased in United States that are being used outside the US)- This Product is produced for sale in the United States. The Nito Bikes Limited Warranty is not applicable for customers who intend to use it outside of the United States. 

7- CLAIMS AND DISPUTE RESOLUTION; GOVERNING LAW AND ARBITRATION

This Warranty shall be interpreted under, and governed by, the laws of the State of California, without regard to the conflict of laws principles. Either Nito Bikes or Customer may elect to have any dispute, claim or controversy arising out of or related to the Product or use of the Product or arising out of or related to this Warranty, including any alleged breach hereof, or any matter governed by this Warranty (collectively, a “Dispute”) resolved through binding arbitration by providing prompt written notice of such election to the other. Upon such election, all such Disputes will be settled exclusively by arbitration with a single arbitrator in accordance with the Commercial Arbitration Rules of the American Arbitration Association (the “Rules”). The arbitration hearing shall take place in Los Angeles, California. Judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. The arbitrator will have the power to render equitable relief as well as monetary damages but shall not have the power to award consequential, punitive, exemplary damages or any other form of relief precluded under the provisions of this Warranty. The arbitrator will have the power to award reasonable fees and expenses in accordance with the Rules.

CUSTOMER UNDERSTANDS AND AGREES THAT, IF EITHER CUSTOMER OR NITO BIKES ELECTS TO ARBITRATE A DISPUTE OR CLAIM, THIS ARBITRATION SECTION PRECLUDES CUSTOMER AND NITO BIKES FROM HAVING A RIGHT OR OPPORTUNITY TO LITIGATE DISPUTES OR CLAIMS THROUGH A COURT, TO BRING A CLAIM AS A PURPORTED CLASS ACTION, OR TO PARTICIPATE OR BE REPRESENTED IN LITIGATION FILED IN COURT BY OTHERS. ALL DISPUTES AND CLAIMS MUST BE RESOLVED AS AN INDIVIDUAL ACTION, NOT AS A CLASS ACTION, THROUGH ARBITRATION IF CUSTOMER OR NITO BIKES TO ARBITRATE.

Subject to the arbitration provisions above, Customer irrevocably submits to the jurisdiction of the Courts of the State of California and the United States District Court of Western Division of California in any Dispute, and hereby irrevocably agrees that all claims in respect of such Dispute may be heard and determined in such state or federal court. Customer agrees that regardless of any statute of law to the contrary, any claim or cause of action Customer may have that arises out of or is related to this Warranty or Nito Bikes must be filed within one (1) year after such claim or cause of action arose. If Customer fails to timely file such claim or cause of action, Customer shall be forever barred from bringing such claim or action against Nito Bikes.
